    I am looking at changing my name legally to Kirsty in the first half of this year. I know the legal procedures required from the QLD Registry of Births, Deaths & Marriages.

    But I do have one question though. The situation is: I am still married at the moment under my male name. If I change my name to Kirsty now, are there going to be any legal ramifications to the marriage between my wife and myself (such as it becoming invalid)?

    I know that this is a question that might require some legal expertise. But i would still appreciate inputs from anyone who is knowledgeable/ had some experience in this matter. Thank you so much.

    Kirsty, I was talking to my solicitor a while back and he told me that it isn’t an issue because my tax file number and Medicare number etc. remain the same. Basically it is just like a woman who gets married and takes her new married name, that’s all. Check up with the legal eagles up there in sunny Qld. too as I’m in NSW don’t forget.

    All may be fine as suggested by Ms Welby, however, you will not be able to change your legal sex with the Registrar of Births until you disolve the pre-existing (legal) marriage

    Thank you for your inputs girls,

    Seems like current legislation will allow me to change my name without implicating my marriage. It is good enough for me at this stage of my transition as far as I would also like to ensure that my wife is not implicated legally as a result of my name change (sigh of relief) :-)

    I know that somewhere down the line, I will be revisiting the quest to obtain my legal gender marker (say in 2-3 years time). Will definitely take all the information you have given at this point in time;-)

    Hi,,

    I would go or ring up your births deaths & marrages office first if its any thing to go by you can change your name by deed poll to any thing that you like . you can not change your main birth cert till you have your s r s & file that then have your marrage anuuld then your birth cert if its the same as us your main cert can be changed to f . if they have changed the laws & then have a civil marrage so do check up first
